SEC charges 69 auditing firms and partners with SOX violation

The Securities and Exchange Commission has issued 69 charges against various accounting firms and partners for violation of a provision of the Sarbanes-Oxley (SOX) Act that requires registration with the Public Company Accounting Oversight Board (PCAOB). Thirty-seven separate firms were involved in the action. No Big Four or major accounting firms were among those charged. This is the first time the SEC has issued such charges.

Fifty of those charged settled on September 13, the day the charges were made. The 28 accounting firms and 22 partners who settled right away were censured by the SEC but not fined. Eighteen of the firms agreed to return a total of $168,150 in audit fees collected from companies that had paid them when they were unregistered.

The Future of Job-boards

What do you think is the future of Job-boards..?

As we know, Job-boards earn their money by selling advertisements to Recruiters. An average vacancy-advertisement on a good job-board costs us somewhere between 150 and 300 dollars.

Now, new networking groups who are able to publish on the Simply Hired Network (which content is republished on popular Job-Board like LinkedIn and MySpace) offer advertisements for just 9$(!) True, the site mentiones that it will be raised to 29$ soon, but that is still very cheap for the exposure you get. Because just publishing on LinkedIn alone costs 145$, targeting the same specialists.

I think this is only the beginning of a new era in online recruitment where prices will drop sharply and candidates will be able to use open groups or even blogs to view those vacancies.

New Executive Pay Disclosures Coming

I post this here because I don't know where else to post it - I wish someone would start a Comp & Benefits group - or am I missing it?

Investors will soon have a new scorecard designed to lay out in plain English just how much pay and perks are being lavished on top executives at public companies. If the goals of federal regulators are met, you won't need an MBA to decipher the numbers.

The new disclosures, in annual reports and proxy statements that will begin arriving later this month, will come closer than ever to a full accounting of total compensation for companies' top two executives and the next three highest-paid executives.

"The SEC, in a very short amount of time for a regulator, has pushed through very sweeping pay disclosures that, for the first time, will give investors a very clear picture of CEO pay," said Amy Borrus, deputy director of the Council of Institutional Investors. "The big picture is a very big win for investors."

Audit relief coming for small businesses

SEC chief accountant says audit relief coming for small businesses WASHINGTON_Revisions to a landmark 2002 anti-fraud law will include relaxing some rules for small public companies in a bid to curb what they say have been excessive costs related to audits, the Securities and Exchange Commission's accounting chief said Monday.

SEC Chief Accountant Conrad Hewitt said regulators are trying to balance the costs and benefits of the Sarbanes-Oxley law's Section 404, which requires companies to file reports on internal financial controls and to fix any problems. Smaller firms especially have complained about the costs of complying with the requirements.

Reducing testing and documentation for businesses between $75 million (?57 million) and $700 million (?531 million) in market capitalization is in the works, and creating a minimum revenue requirement for companies is also a possibility, Hewitt told reporters following his speech at an American Institute of Certified Public Accountants conference.

The World of Compliance

Hi,

I am new to this group and was wondering if there is a directory that breaks down the different functions and titles in compliance, auditing, risk, regulatory etc by profession or industry. I'm having a tough time understanding the definition of all the different roles in compliance and trying to organize them. I mean I would think you would look at the industry first for instance Accounting and then look into compliance professionals within the accounting industry. But some accounting compliance professionals also obviously work in other industries from A to Z. Any insight or resources out there that can better organize the categories, sectors, sub types of compliance positions, titles and practice disciplines. Thanks guys.

As the SEC, an investor protection agency that demands tight internal controls from the companies it oversees, was recently criticized by congressional investigators for not having its own house in order when it comes to cyber security.

?Overall, the SEC has not effectively implemented information security controls to properly protect the confidentiality, integrity, and availability of its financial and sensitive information and information systems," the GAO concluded.
